Back to the future again? Over the past year the industry has seen an increased activity by the FDA and the FTC, and the creation of a new regulatory tool, the joint FDA/ FTC warning letter. With the advent of social media, not only do regulators have an easier time finding your products and claims, but consumers have found a new voice and are more effective in communicating their product opinions and complaints, not just to marketers, but to the FDA, states attorney generals and to the plaintiffs bar.
